Blythe SP-01-60 3 <br /> Board of Appeals <br /> SPECIFIC FINDINGS j <br /> The Board determined that <br /> 1. the proposed dock will be an accessory to an existing dwelling and is a �+ <br /> permissible use upon the grant of a Special Permit. <br /> 2. the proposal has been approved by the Harbormaster and the Shellfish <br /> Constable whose responsibilities include safety on the water and protection of <br /> the marine environment. <br /> 3. the proposal has been reviewed by the,Conservation Commission to address 1 <br /> impacts on the coastal environment. f <br /> 4. the proposal has been approved by the Waterways Commission. ;! <br /> 5. the proposed project as designed will ensure that: a) impacts to shellfish and <br /> eelgrass are negligible; b) turbidity, either through construction impacts or <br /> propeller wash, are minimized; c) dune vegetation is undisturbed and <br /> pedestrian foot traffic for pedestrian access between the tide lines is i <br /> unimpeded. j <br /> 6. the use is in harmony with the general purpose and intent of the By-laws. <br /> 7. the owner has rights to maintenance in perpetuity. <br /> 8. filing with the Corps of Engineers shall be considered execution of the Special ] <br /> 3) <br /> Permit. <br /> i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on July 11, <br /> 2001 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: 1 <br /> i <br /> 1. that the Petitioner shall supply a true attest copy of the Agreement for <br /> Judgment and such documentation must accompany the Decision granted by <br /> the Zoning Board of Appeals. <br /> 2. that the proposed construction shall be a shared facility together with the <br /> Petitioner, Mr. Siegfried and Mr. Siegfried's successors, heirs and assigns in <br /> perpetuity. <br /> 3.
