Mashpee Zoning Frederic W. Blythe SP-01-60 2 <br /> Board of Appeals <br /> Mr. Gary Eynation, a Mashpee resident, also expressed concern about the safety <br /> of children playing in the area. <br /> Board members asked if installation of a gate would be a good idea. Mr. Blythe <br /> replied that anyone accessing the beach has to walk across his land and that he has never I <br /> gated his property. Mr. Blythe said that the dock is not raised and goes right into the <br /> i <br /> beach. <br /> The Petitioner is scheduled for a Conservation Commission hearing on June 7, <br /> 2001. The Board received a memo from the Shellfish Constable requesting more <br /> information on the proposal. Mr. Jim Hanks from the Waterways Commission asked for <br /> continuance of the hearing to allow the Petitioner an opportunity to submit plans to that <br /> Commission. <br /> The Board moved to continue the hearing until June 13, 2001 to allow the <br /> Petitioner an opportunity to receive Conservation Commission, Shellfish and Waterways ] <br /> Commission approval. <br /> At the continued Public Hearings on June 13, 2001, Attorney Paul Wightman j <br /> represented the Petition and stated that the Conservation Commission has approved the ' <br /> project, pending approval from the Zoning Board of Appeals. <br /> Mr. Jim Hanks of the Waterways Commission attended the meeting and said that I <br /> the Waterways Commission has not yet received any documentation regarding the I� <br /> proposal. <br /> The Board moved to continue the hearing until July 11, 2001 to allow for <br /> approval from the Waterways Commission. <br /> At the continued Public Hearings on July 11, 2001, Attorney Paul C. Wightman <br /> and Engineer Dave Reall represented the proposal. Mr. Blythe also attended the meeting. <br /> The Conservation Commission, Harbormaster, Shellfish Constable and <br /> Waterways Commission have all expressed approval of the project. <br /> I <br /> No comments were received from abutters at this meeting. j <br /> GENERAL FINDINGS <br /> 1, that the subject property is located at 228 Wading Place Road and consists of <br /> 23,700 square feet of land fronting on Popponesset Creek. <br /> ! <br /> SPECIAL PERMIT CRITERIA j <br /> Section 174-25.I.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation of the marine or coastal environment. i <br /> i <br />
