Mashpee Zoning Minutes—June 13, 2001 3 <br /> Board of Appeals <br /> Mr. Govoni said that he understands the problem, but that the Conservation regulations <br /> require a 50-foot setback to the wetlands, which force construction closer to the street <br /> line. <br /> Mr. Nelson moved to grant a Variance of 11.5 feet from the rear setback requirements <br /> and a Variance of 9 feet from the front setback requirements. Mr. Nelson moved to Deny <br /> the request for a height variance. The Variance is subject to findings 1, 2, 3, 4, shape, <br /> topography, the lot's close proximity of wetlands, installation of a Title V septic system <br /> would be an improvement, the lot was create prior to adoption of Zoning By-laws and <br /> that no hardship has been established to prove hardship to allow for a height variance. <br /> Mr. Brem seconded. All agreed. <br /> Albino Marusich—Requests a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Great River on property <br /> located in an R-3 zoning district at 376 Monomoscoy Road (Map 125 Block 18) <br /> Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> Mr. Jeffrey Ryther of BSS Design represented the Petition and stated that the proposal <br /> was designed after he met with Conservation Commission agent Bob Sherman and <br /> Harbormaster Perry Ellis to go over details. Mr. Ryther said that the existing old boat <br /> slip would be replaced with the new construction. <br /> The Shellfish Constable has approved the proposal contingent upon minor revisions. The <br /> Conservation Commission has approved the project. �. <br /> Ms. Audrey K. Nickerson, a direct abutter at 374 Monomoscoy Road, reviewed the plans. <br /> Mr. Govoni explained that the proposal would avoid the shellfish areas. She expressed <br /> no opposition to the project. No other comments were received from abutters. <br /> Ms. Elizenberry moved to grant the Special Permit, subject to findings 1, 2, 3, 4, 5, 6. <br /> Mr. Nelson seconded. All agreed. ! <br /> Z. J. Realty Trust—Requests a Special Permit under Sections 174-25.D.1, 174-25.G.4, <br /> 174-25,G.5, 174-25.G.6 and 174-25.G.7 of the Zoning By-laws for permission to <br /> conduct a landscape/contractor's business and wholesale business with office space <br /> and equipment and truck storage on property located in an I-1 zoning district at 108 <br /> Echo Road (Map 19 Block 8) Mashpee, MA. Owner of record: Patricia Crosby. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Richard T. Guerrera. <br /> Attorney Kevin M. Kirrane represented the Petition and stated that it has been approved <br /> by the Design Review Committee and the Technical Review Committee. Mr. Brett Field, <br /> who is the owner of the company that proposes to establish a landscape/contractor's <br /> business on the subject property, also attended the meeting. <br />
