Webster V-01-64 2 <br /> Board of Appeals <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and 4 <br /> ..K ;.r. <br /> not the district in which it is located and that a literal enforcement of the By-laws would `` { <br /> involve hardship to the petitioner. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 409 Monomoscoy Road and consists of <br /> 16,750 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the long and narrow shape and topography affect the subject lot and not the <br /> district in which it is located. <br /> 2. the subject property fronts on Little River and is impacted by wetlands; <br /> therefore, a literal enforcement of the By-laws would involve hardship to the <br /> petitioner. <br /> 3. -relief may be granted without derogating from the intent or purpose of the <br /> s <br /> By-laws. <br /> 4. the proposed addition and removal of the existing shed would be an <br /> improvement to the property;therefore,relief may be granted without <br /> detriment to the public good. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that <br /> the applicant met the criteria necessary for the granting of a Variance. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on June 13, <br /> 2001 to grant a Variance of 17 feet from the setback requirements to water and wetlands. <br /> The Variance is conditioned upon compliance with the following: <br /> 1. Cape & Islands Engineering Plan entitled"Proposed Site Plan Located in <br /> Mashpee—Mass.,Prepared for Robert Webster,Plan No. 112399, Scale: <br /> 1"=20 FT., Date:Nov. 23, 1999". <br /> 2. Yarosh Associates, Inc.,Plan entitled"Webster Residence,409 Monomoscoy <br /> Road Mashpee, Date: 1 —2000, Project Number 942". <br />
