Mashpee Zoning Minutes—July 11, 2001 2 Board of Appeals F4 Sitting: Edward M. Govoni Robert G. Nelson and Marshall A. Brem. Mr. and Mrs. Rothschild represented their Petition. Mr. Rothschild stated that he is requesting permission to demolish the existing dwelling on the subject property to allow for construction of a new single-family home. The proposal meets all the setback and lot coverage requirements. A new septic system will be installed on the subject property. F f. No comments were received from abutters. Mr. Brem moved to grant a Special Permit, subject to: • findings—that the proposal would be an improvement to the property and to the neighborhood. `, • Cape & Islands Engineering plan entitled "Single Family Residence, Proposed ,x Sewage Disposal System Prepared for Phillip Rothschild, Hse. No. 14 Pine Street, Mashpee, Mass., Plan No. 070601, Date: July 6, 2001". Mr. Nelson seconded. All agreed. #!a' CONTINUED HEARINGS `s Frederic W. Bl tghe—Requests a Special Permit under Section 174-25.1.9 of the Zoning By-laws for permission to construct a pier, ramp and float on Popponesset Creek on property located in an R-3 zoning district at 228 Wading Place Road (Map 112 Block 59) Mashpee, MA. r; Sitting: Robert G. Nelson, Zella E. Elizenberry and Marshall A. Brem. Attorney Paul C. Wightman and Engineer Dave Reall represented the proposal. Mr. Blythe also attended the meeting. The Waterways Commission, Shellfish Constable Harbormaster and Conservation Commission have expressed approval of the project. AlA Mr. Nelson questioned the slight difference in language in the two Agreements for s Judgment. Attorney Wightman informed the Board that "their heirs, assigns and z` successors in interest" was added to allow any future new owner of the abutting lot the rights to inherit use of the proposed pier, ramp and float. The word "cigarette" was also added to the judgment for clarification. Attorney Wightman said that he would obtain a true attest copy that will be attached to the ZBA decision. r� r,. Mr. Brem commented that he visited the area over the weekend and noticed the large amount of children in the area who had parked their bicycles on Mr. Blythe's land. He v said that it looked as though they were all playing in an area that was not anywhere near the site of the proposed dock.
