Mashpee Zoning Minutes—July 11, 2001 2 <br /> Board of Appeals <br /> F4 <br /> Sitting: Edward M. Govoni Robert G. Nelson and Marshall A. Brem. <br /> Mr. and Mrs. Rothschild represented their Petition. Mr. Rothschild stated that he is <br /> requesting permission to demolish the existing dwelling on the subject property to allow <br /> for construction of a new single-family home. The proposal meets all the setback and lot <br /> coverage requirements. A new septic system will be installed on the subject property. <br /> F <br /> f. <br /> No comments were received from abutters. <br /> Mr. Brem moved to grant a Special Permit, subject to: <br /> • findings—that the proposal would be an improvement to the property and to <br /> the neighborhood. <br /> `, • Cape & Islands Engineering plan entitled "Single Family Residence, Proposed <br /> ,x <br /> Sewage Disposal System Prepared for Phillip Rothschild, Hse. Bl tghe—Requests a Special Permit under Section 174-25.1.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Popponesset Creek on <br /> property located in an R-3 zoning district at 228 Wading Place Road (Map 112 Block 59) <br /> Mashpee, MA. <br /> r; Sitting: Robert G. Nelson, Zella E. Elizenberry and Marshall A. Brem. <br /> Attorney Paul C. Wightman and Engineer Dave Reall represented the proposal. Mr. <br /> Blythe also attended the meeting. <br /> The Waterways Commission, Shellfish Constable Harbormaster and Conservation <br /> Commission have expressed approval of the project. <br /> AlA <br /> Mr. Nelson questioned the slight difference in language in the two Agreements for <br /> s Judgment. Attorney Wightman informed the Board that "their heirs, assigns and <br /> z` successors in interest" was added to allow any future new owner of the abutting lot the <br /> rights to inherit use of the proposed pier, ramp and float. The word "cigarette" was also <br /> added to the judgment for clarification. Attorney Wightman said that he would obtain a <br /> true attest copy that will be attached to the ZBA decision. <br /> r� <br /> r,. <br /> Mr. Brem commented that he visited the area over the weekend and noticed the large <br /> amount of children in the area who had parked their bicycles on Mr. Blythe's land. He <br /> v said that it looked as though they were all playing in an area that was not anywhere near <br /> the site of the proposed dock. <br />
