TOWN OF MASHPEE <br /> Minutes—Zoning Board of Appeals <br /> Wednesday, July 25, 2001 <br /> The Mashpee Zoning Board of Appeals held Public He on Wednesday, <br /> July 25, 2001, at 7:30 P.M. at the Mashpee Town Hall. Board Members present <br /> were Vice Chairman James E. Regan III and Associate Members Richard T. Guerrera, <br /> Zella E. Elizenberry, Marshall A. Brem and Frederick R. Borgeson. Building <br /> Commissioner Russell W. Wheeler also attended the meeting. Chairman Edward M. <br /> Govoni and Clerk Robert G. Nelson were not present. <br /> PUBLIC HEARINGS <br /> Vivian G. Williams—Requests a Variance from Sections 174-31 and 174-32 of <br /> the Zoning By-laws for permission to vary the lot size, lot frontage and fire protection <br /> access requirements to allow for construction of a single-family home on an unpaved <br /> road on property located in an R-3 zoning district at 24 Coombs Lane (Map 44 <br /> Block 117) Mashpee, MA. <br /> The Petitioner was unable to attend the Public Hearings. The Board voted unanimously <br /> to continue the Petition until August 8, 2001. <br /> Stephen M. & Sarah A. Daley—Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the side and front setback requirements to allow for <br /> construction of a deck to an existing home on property located in an R-3 zoning district <br /> at 219 Waterway (Map 111 Block 74) Mashpee, MA. <br /> Sitting: James E. Regan 11I, Zella E. Elizenberry and Marshall A. Brem. <br /> Mr. Daley represented his Petition and stated that the Variance granted by the ZBA in <br /> fi <br /> 2000 to allow for extension of his deck has lapsed. Mr. Daley said that he has been <br /> unable to contract a builder to start construction. <br /> No comments were received from abutters. <br /> av Mr. Borgeson moved to grant the following: <br /> 4i <br /> tt' • a Variance of 4.3 feet from Waterway to the existing dwelling; <br /> f • a Variance of 15.5 feet from Waterway to the proposed deck. <br /> • a Variance of 6.8 feet from Bosun's Lane to the proposed deck. <br /> The Variance is subject to the same findings as specified in Variance, V-00-115, and that <br /> the subject lot is abutted on three sides by streets and has an unusual shape. Mr. Brem <br /> seconded. All agreed. <br />
