Mashpee Zoning Minutes—July 25, 2001 2 <br /> Board of Appeals <br /> Mr. Jim Hanks and several other residents of Monomoscoy Road attended the meeting <br /> and asked if the Board was going to discuss the July 17, 2001 letter from Town Planner <br /> Thomas Fudala addressed to Mr. Hanks. The Board informed the residents that they <br /> must formally request a hearing with the Board in order to be included on the agenda. <br /> The Board told the attendees that they must contact the ZBA office with a specific <br /> request and a Public Hearing date would be determined. <br /> Mr. Brady of Monomoscoy Road asked if he could address the Board. Mr. Borg eson said <br /> G¢ that the Petitioners who were scheduled to be on the Agenda had a right to be heard first. <br /> Mr. Brady indicated that he was also interested in one of the Petitions. <br /> Edwin A. Monteiro—Requests a Variance from Section 174-32 of the Zoning By-laws <br /> for permission to vary the fire protection access requirements to allow for construction <br /> ' of a single-family home on an unpaved road on property located in an R-3 zoning district <br /> at 48 Blue Castle Drive (Map 104 Block 13) Mashpee, MA. Owner of record: John G. <br /> Bynoe. <br /> Sitting: James E. Regan III, Richard T. Guerrera and Zella E. Elizenberry. <br /> Mr. Monteiro, builder for the project, represented the Petition and stated that the ZBA <br /> granted a Variance allowing construction on the subject property in 1994 when Mr. <br /> Bynoe was contemplating selling the lot. Mr. Monteiro said that Mr. Bynoe is hoping to <br /> construct a single-family ranch-style home for his personal use on the subject property. <br /> Mr. Regan noted that Mr. Bynoe has owned the property since 1969. He also said that <br /> s the owners of the other homes on the unpaved road cooperate and maintain the road on a <br /> regular basis. <br /> Mr. Brem said that there are currently several homes on Blue Castle Drive and that <br /> emergency vehicles have no problem accessing the road. <br /> F?` No comments were received from abutters. <br /> Ms. Elizenberry moved to grant the Variance to Mr. John G. Bynoe, subject to the same <br /> findings as Variance, V-95-6. Mr. Guerrera seconded. All agreed. <br /> A <br /> Peter R. & Carolie D. Owens—Request a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand a pre-existing, non-conforming structure to <br /> allow for construction of a garage and an addition to the structure on property located <br /> in an R-3 zoning district at 16 Spoondrift Circle (Map 111 Block 118) Mashpee, MA. <br /> Peter R. & Carolie D. Owens—Request a Variance from Sections 174-31 and 174-33 of <br /> the Zoning By-laws for permission to vary the side, front and lot coverage requirements <br /> and the setback requirements to water and wetlands to allow for construction of a garage <br /> and an addition to a pre-existing, non-conforming structure on property located in an R-3 <br /> zoning district at 16 Spoondrift Circle (Map 111 Block 118) Mashpee, MA. <br />
