Owens of <br /> Bedford, New Hampshire for a Variance from Sections 174-31 and 174-33 of the Zoning <br /> By-laws for permission to vary the side, front and lot coverage requirements and the <br /> } <br /> setback requirements to water and wetlands to allow for construction of a garage and an <br /> r <br /> addition to a pre-existing, non-conforming structure on property located in an R-3 zoning <br /> district at 16 Spoondrift Circle (Map 111 Parcel 118) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> ` a newspaper of general circulation in the Town of Mashpee, on July 6 and July 13, 2001, <br /> J <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> 3 Wednesday, July 25, 2001, at which time the following members of the Zoning Board <br /> k?, <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Richard T. Guerrera. <br /> k The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and <br /> stated that the subject lot is not in the New Seabury Special Permit area. Mr. Slavinsky <br /> said that the Petitioner is requesting Variance relief due to the soil conditions, the strange <br /> triangular shape and the close proximity to wetlands of the subject lot. The proposed <br /> construction of an addition and a garage would be less than 10 feet from the property line <br /> on three sides of the subj ect property. <br /> The Conservation Commission refuses to allow any construction within the <br /> 50-foot buffer. The Board of Health has approved the proposal. <br /> a <br />
