Mashpee Zoning Peter R. & Carolie D. Owens V-01-78 2
Board of Appeals
;t
No comments were received from abutters.
The Board expressed concern with the proposed construction being so close to the
streetline.
The Board voted unanimously to continue the Petition until August 8, 2001 to
y allow Mr. Slavinsky an opportunity to provide more information on the abutting homes
and their distance from the streetline and for clarification of the New Seabury Special
Permit area.
} At the continued Public Hearings on August 8, 2001, Mr. John Slavinsky of Cape
s & Islands Engineering represented the Petition and referred to the revised plans. Mr.
Slavinsky said that the Petitioner bought the subject property under the impression that it
F' was in the Special Permit area and that the property was exempt from the current Zoning
is
.m By-laws. He stated that other homes in the area are closer to the streetline than the
proposed construction and that the subject lot has an unusual shape and topography.
Mr. Brem visited the subject property and stated that the proposal would be
detrimental to the area and may cause problems with the neighbors. He expressed
surprise that no abutters have voiced opposition to the proposal. Mr. Borgeson said that
he also visited the subject property.
After some discussion, Mr. Slavinsky requested a Withdrawal Without Prejudice
of the above-referenced Petition for a Variance, V-01-78.
The Board voted unanimously to accept the Request for Withdrawal Without
Prejudice of the above-referenced Petition.
