Mashpee Zoning Minutes—August 8, 2001 2 <br /> Board of Appeals <br /> fMrs. Williams represented her Petition and stated that the Variance granted by the Board <br /> on the subject lot in 1998 has lapsed. She is seeking Variance relief from the lot size <br /> requirements to allow for the sale of the lot. <br /> z <br /> w: <br /> ii <br /> { No comments were received from abutters. <br /> Mr. Regan moved to grant the following: <br /> • a Variance of 55,138 square feet from the lot size requirements. <br /> • a Variance of 42.81 feet from the frontage requirements. <br /> fb <br /> The Variance is subject to same findings as V-98-131 and plan J#51732A, dated <br /> 10/28/98. Mr. Nelson seconded. All agreed. <br /> rX Peter R. & Carolie D. Owens—Request Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand apre-existing, non-conforming structure to <br /> allow for construction of a garage and an addition to the structure on property located <br /> 4: <br /> in an R-3 zoning district at 16 Spoondrift Circle (Map 111 Parcel 118) Mashpee, MA. <br /> Gt` Continued from 7/25/01 Public Hearings to allow for engineer to conduct research <br /> concerning the New Seabury Special Permit area and the distance of abutting homes <br /> from the street line. <br /> } Peter R. & Carolie D. Sitting: Edward M. Govoni, James E. Regan III and Richard T. Guerrera. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petitions and referred <br /> to the revised plans. Mr. Brem visited the subject property and said that the proposal <br /> would be detrimental to the area and may cause problems with the neighbors. He said <br /> that the houses and lots are very small and very close to each other. Mr. Borgeson said <br /> that he also visited the subject property and that the proposal seems to be low profile. <br /> Mr. Slavinsky said that the hardship is that the Petitioner bought the property under the <br /> F impression that it was in the Special Permit area, exempting the lot from current zoning <br /> By-laws. He stated that other homes in the area are closer to the street line than the <br /> proposed construction. Mr. Slavinsky said that the lot has an unusual shape and <br /> topography. <br /> After some discussion, Mr. Slavinsky requested a Withdrawal Without Prejudice of the <br /> above-referenced Petitions. The Board voted unanimously to accept the request. <br />
