Mashpee Zoning Minutes—August 22, 2001 4 <br /> Board of Appeals <br /> Ms. Elizenberry asked Attorney Bergamo to identify the lots that are currently under <br /> l <br /> purchase and sale agreement. Attorney Bergamo repeated what she said earlier in her <br /> presentation. (Please refer to paragraph one of the previous page). <br /> Mr. Guerrera said that he didn't see any reason not to grant the Petitioner the relief being <br /> sought. Mr. Govoni agreed and said that the ZBA established that Variance relief could <br /> be granted in the past, that the project would improve the neighborhood and community <br /> and would add tax revenue to the Town. He said that a hardship also exists because of <br /> the growth management cap. Mr. Govoni mentioned that if the proposal had been filed <br /> under one project, then the development would probably qualify as "substantial <br /> ;r completion" and wouldn't need Variance relief. However, that is not the case since the <br /> Petitioner has requested Variance relief on each lot as a separate project. <br /> `$ Attorney Bergamo apologized for the confusion and stated that building permits were <br /> issued for some of the lots after the Petitions had been filed with the ZBA. Mr. Govoni <br /> said that it was fortunate that the Petitioner filed a separate Petition on each lot, since that <br /> tf <br /> gives the Board the opportunity to differentiate the lots that need Variance relief. <br /> No comments were received from abutters. <br /> t <br /> -' Mr. Nelson moved: <br /> • to grant Variance relief of 14,054 square feet on Lot 20, V-01-84-12. <br /> • to continue the remaining Petitions until the September 12, 2001 Public <br /> Hearings. <br /> r; Mr. Guerrera seconded. All agreed. <br /> Jared West—Requests a Special Permit under Section 174-25.I.12 of the Zoning By-laws <br /> for permission to park and use a trailer for temporary occupancy incidental to the <br /> construction of a single-family home on property located in an R-5 zoning district at 15 <br /> Blackwatch Road (Map 16 Parcel 59) Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> �t <br /> Mr. Jared West represented his Petition and stated that he would like the option of having <br /> permission to use a mobile home for a couple of reasons. He said that, in the event that <br /> his current dwelling is sold before completion of construction of his new home, he would <br /> t need somewhere to live. Mr. West indicated that the subject property had been <br /> w designated as a park area at one time and was now being used`as a "party spot". He said <br /> that he met some of the youths that were using the property and they voiced their extreme <br /> displeasure that the lot was going to be developed. Mr. West expressed concern of the <br /> + possibility of vandalism during the construction process.
