x
Mashpee Zoning Minutes—August 22, 2001 5
Board of Appeals
Mr. John Casey, an abutter at 25 Leamington Lane, asked if the Board had granted
"Variances" of this kind in the past. Mr. Govoni corrected Mr. Casey and said that the
Petitioner was requesting a Special Permit. The Board recently granted such a Special
' Permit and limited the time period that the trailer could be used on the subject property.
Although the By-laws state that the time period is not to exceed 6 months, Mr. Govoni
indicated that the Board would consider grant of a Special Permit allowing for the use of
the trailer for a period not to exceed four months.
Mr. West said that four months would be sufficient.
Mrs. Linda Casey, an abutter, said that she was told that the land was designated as
Conservation land when she purchased her home. She asked why the trailer would
remain on the property even after construction of the home. Mr. Govoni said that Mrs.
Casey would have to research the exact language of the restrictive covenants for the
neighborhood.
q
Mr. West asked ermission to address the question and stated that the "trailer" is a
p
o recreational vehicle that will be used for camping purposes. He also said that that the
restrictive covenants do specify where a vehicle of that type can be located on a property.
rt
R}of
Mrs. Casey asked who would "police"the area and determine that the Petitioner was not
using the recreational vehicle as a place of residence once the home has been constructed
r
on the site. Mr. Govoni assured Mrs. Casey that the Building Commissioner would
ensure that the recreational vehicle had been disconnected from water and sewage before
issuing an occupancy permit for the home. Mr. Wheeler confirmed Mr. Govoni's r
statements.
Mr. West said that he wanted to set Mrs. Casey's mind to ease and that "it's not our
goal"and that "we don't want to live in a trailer" and that the home would be constructed
f, within a six-month period.
No other comments were received from abutters.
Mr. Nelson moved to grant a Special Permit to allow for use of a mobile home on the
subject property for temporary use as office and living space. The Special Permit is
conditioned upon the following:
• Board of Health approval of the septic and water connection to the mobile
home. f
• plan dated June 21, 2001.
P • the use of the mobile home on the subject property for temporary use as office
and living space shall not exceed a period of four months.
• the above-referenced four-month period shall commence on November 1,
2001 and conclude on February 28, 2002.
Ms. Elizenberry seconded.
