Tiberio—Requests a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Ockway Bay on property <br /> located in an R-3 zoning district at 15 Ockway Bay Road (Map 99 Block 48) Mashpee, <br /> MA. Continued to alloii,for Conservation Connnzission approval. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Richard T. Guerrera. <br /> The Petitioner failed to file a Petition for a Variance and failed to provide revised plans as <br /> requested by the Board at the Public Hearings held on August 8, 2001. <br /> In order to avoid a constructive grant, the Board voted unanimously to Deny Without <br /> Prejudice the above-referenced Petition. The Petitioner still has the right to Petition for a <br /> Variance and a Special Permit to allow for construction of the proposed pier, ramp and <br /> rr float on the subject property. <br /> Because notice was not properly published by the Mashpee Enterprise, the Mashpee <br /> Zoning Board of Appeals has canceled the following Public Hearings scheduled for <br /> August 8, 2001 and rescheduled them to August 22, 2001: <br /> N�s <br /> Jonathan H. Leach, V.M.D. —Requests a Special Permit under Sections 174-25.E.7 and <br /> fT 174-82 of the Zoning By-laws for permission to conduct a Veterinary establishment <br /> within the Groundwater Protection District on property located in a C-2 zoning district <br /> at 482 Main Street (Map 27 Parcel 122) Mashpee, MA. <br /> Jonathan H. Leach, V.M.D. —Requests a Variance from Section 174-31 of the Zoning <br /> {' By-laws for permission to vary the frontage and setback requirements to allow for the <br /> construction of a Veterinary establishment within the Groundwater Protection District <br /> on property located in a C-2 zoning district at 482 Main Street (Map 27 Parcel 122) <br /> Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> �k. <br /> Attorney Dan Mullin represented the Petition. Dr. Jonathan Leach, Site Engineer <br /> Christopher Costa and Project Builder Tom Maronery attended the meeting along with <br /> several Mashpee residents in support of the proposal. <br /> Attorney Mullin stated that Dr. Leach and his late father, Dr. Daniel F. Leach, have <br /> practiced Veterinarian medicine on Cape Cod for over 65 years and that "Dr. Leach's <br /> practice is unique in that he is one of the leading horse veterinarians in New England". <br /> As Attorney Mullin brought out, horses "still enjoy the benefit of the doctor coming to <br /> see them instead of them going to see the doctor". Dr. Leach estimates that 50% of his <br /> practice will involve the care of horses (house calls) and the rest of his practice will <br /> involve the care of small animals on the subject property. <br /> I ' <br /> E _._ <br />
