4 <br /> 1 4 <br /> Town of Mashpee <br /> 3 <br /> 16 Great Xeck Pvoad Xorth <br /> o ` ' MASHPEE ZONING BOARD OF APPEAL§Washpee, Massachusetts 02649 <br /> urj <br /> I <br /> Decision for a Special Permit <br /> I <br /> RE: Steven&Joyce Hynds SP-01-105 333 Monomoscoy Road <br /> Map 120 Parcel 28 <br /> A Petition was filed on September 25, 2001 by Steven and Joyce Hynds <br /> of Watertown, Massachusetts for a Special Permit under Sections 174-20 and 174-25.A.8 <br /> of the Zoning By-laws to allow for demolition of an existing dwelling and construction <br /> of a new home with an in-law apartment on property located in an R-3 zoning district <br /> at 333 Monomoscoy Road (Map 120 Parcel 28) Mashpee, MA. <br /> 1 i <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 5 and October <br /> 12, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 24, 2001, at which time the following members of the Zoning Board !� <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> i <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. and Mrs. Hynds represented the Petition for permission to demolish an <br /> existing dwelling and construct a new home with an in-law apartment on the subject <br /> property. Mr. Hynds stated that plans call for extension of the roofline that would <br /> connect the addition to the house. <br /> I <br /> No comments were received from abutters. <br /> i <br /> SPECIAL PERMIT CRITERIA <br /> § 174-20 of the Zoning By-laws states: <br /> "Rebuilding of destroyed or damaged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt subject to approval of the Board of Appeals subject to <br /> Y � J pp <br /> the same conditions as set forth in § 174-24 of this chapter". <br /> GENERAL FINDINGS j <br /> I. that the subject property is located at 333 Monomoscoy Road and consists of <br /> 1.47 acres of land. <br /> i <br />
