Nelson, Frederick R. Borgeson and Marshall A. Brem. <br /> Mr. Nelson referred to Section 174-26 of the Zoning By-laws Growth management. <br /> A. Development phasing. Within any year, building permits may be issued for new <br /> dwellings on no more than twenty percent(20%)of the lots in any subdivision j <br /> approved by the Mashpee Planning Board under the Massachusetts Subdivision Control <br /> Law(the most recent such plan applicable to the lot shall apply), or twenty percent <br /> (20%) but at least one(1) of the lots shown on a plan of land not requiring subdivision ! <br /> approval recorded after May 11, 1987, or twenty percent(20%) of the approved <br /> I <br /> dwelling units in any other type of residential or mixed-use development under a <br /> special permit. Such limit shall not apply to any other preexisting and otherwise <br /> buildable lot. In the case of fractional numbers greater than one-half(1/2),the i <br /> number of permits issued may be rounded upward. <br /> �I I <br /> Mr.Nelson asked if Mr. Govoni couldull building permits for two <br /> p g <br /> of the subject <br /> properties this year and two building permits for the other two properties next year. Mr. <br /> i <br /> Wheeler confirmed that Mr. Govoni could do so. Mr. Nelson replied that Mr. Govoni <br /> doesn't actually need Variance relief from the Growth Management By-laws. <br /> laws. <br /> ! <br /> After a brief discussion, Mr. Govoni requested Withdrawal without Prejudice of the <br /> above-referenced Petitions. <br /> Mr. Nelson moved to accept the request for Withdrawal. Mr. Borgeson seconded. All <br /> agreed. <br /> Mr. Gordon G. Swanson requested a Withdrawal Without Prejudice of his Petition for a <br /> Variance. The Petition has not been advertised.
