Mashpee Zoning Peter R. & Carolie D. Owens SP-01-95 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 16 Spoondrift Circle and consists of <br /> 12,075 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed construction does not conform to the setback requirements and <br /> the Board has granted a Variance from the setback requirements on the <br /> easterly, westerly and southerly sides of the subject lot. <br /> 2. there is adequate land area to provide sufficient parking. <br /> 3. while the proposed construction will increase the non-conforming nature of j <br /> the structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 4. the immediate neighborhood consists of single-family homes of similar size. <br /> Many have been improved with additions or reconstruction. <br /> 5. due to the unusual shape of the lot,there is no other location for the <br /> construction. <br /> 6. the majority of the Bright Coves Association is part of the New Seabury <br /> Special Permit dating back to 1963 -the subject lot was created prior to the ' <br /> Special Permit. <br /> ili 'I i I <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that <br /> the Petitioner met the criteria necessary for the granting of a Special Permit. Upon I <br /> motion duly made and seconded, the Zoning Board of Appeals voted unanimously <br /> on October 10, 2001 to grant a Special Permit to allow for expansion of a pre-existing, <br /> non-conforming structure. <br /> i <br /> The Special Permit is conditioned upon compliance with Cape & Islands Ir <br /> Engineering plans entitled"Plan of Addition& Garage Located in Mashpee, Mass., <br /> Prepared for Peter Owens, Date: June 20, 2001, Revd.
