Mashpee Zoning Minutes — November 14, 2001 <br />Board of Appeals <br />No comments were received from abutters. <br />• Mr. Brem moved to grant the Special Permit to allow for demolition of the building <br />designated as 25C on the submitted plan. The Special Permit is subject to installation of <br />a new Title V septic system for the above -referenced home. The Special Permit is <br />subject to findings/criteria 1 through 12 for demos/rebuilds. Mr. Nelson seconded. All <br />agreed. <br />John G. & Diane Mates. Jr. — Request a Special Permit under Section 174-20 of the <br />Zoning By-laws for permission to demolish an existing structure and construct a <br />single-family home on property located in an R-5 zoning district at 53 Hooppole Road <br />(Map 64 Parcel 20) Mashpee, MA. <br />Sitting: James E. Regan III, Robert G. Nelson and Marshall A. Brem. <br />Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and stated <br />that the proposal calls for demolition of the existing dwelling and construction of a new <br />three-bedroom home on the subject property. The Conservation Commission has <br />approved the project. The Board of Health has approved installation of a new Title V <br />septic system to replace the existing cesspool. <br />Mr. Nelson asked about the electrical and telephones lines that appear to cross through <br />the subject property. Mr. Slavinsky said that the utility poles would be removed. Mr. <br />• Nelson questioned if there was an easement on the property. Mr. Slavinsky replied that <br />thereis no easement on the subject property. Mr. Nelson said that he wanted reassurance <br />that the proposal does not encroach on the utility lines. <br />No comments were received from abutters. <br />Mr. Brem moved to grant the Special Permit; subject to findings/criteria 1 through 12. <br />Mr. Nelson seconded. All agreed. <br />John B. & Elaine Wilson — Request a Modification to Special Permit, SP -00-23, to allow <br />for construction of a detached garage to an existing home on property located in an R-3 <br />zoning district at 202 Monomoscoy Road (Map 114 Parcel 43A) Mashpee, MA. <br />Sitting: James E. Regan III, Robert G. Nelson and Marshall A. Brem. <br />Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and stated <br />that changes have been made to the original plan to include addition of a garage to the <br />dwelling on the subject property. Because the plans were changed to include the addition <br />of the garage, Building Commissioner Russell W. Wheeler required the Petitioner to seek <br />permission from the ZBA for a Modification to the Special Permit granted by the Board <br />on February 23, 2000.
