Mashpee Zoning Minutes — November 14, 2001 <br />Board of Appeals <br />• Messrs. Brem and Nelson said that they visited the site and that addition of a garage to <br />the dwelling would ruin the aesthetic look of the property. Mr. Brem was puzzled that <br />none of the abutters from Monomoscoy Island attended the meeting. <br />Mr. Slavinsky said that no Variance relief is being requested. Mr. Regan stated that the <br />proposal meets the setback and lot coverage requirements and questioned why the <br />Petitioner is seeking ZBA relief. <br />After some discussion, the Board determined that the Petitioner does not need ZBA <br />approval to allow for construction of the garage to the dwelling on the subject property <br />and that the ZBA does not have jurisdiction regarding this particular Petition. Mr. Regan <br />moved to find that determination. Mr. Nelson seconded. All agreed. <br />Richard M. & Ann M. Sargent.Jr. — Request a Variance from Section 174-33 of the <br />Zoning By-laws for permission to vary the setback requirements to water and wetlands to <br />allow for addition of a bedroom and garage to an existing dwelling on property located in <br />an R-3 zoning district at 25 Taffrail Way (Map 112 Parcel 34) Mashpee, MA. <br />Mr. John Slavinsky of Cape & Islands Engineering requested continuance of the <br />above -referenced Petition to allow for Conservation Commission approval. The Board <br />voted unanimously to continue the Petition until December 12, 2001. <br />CONTINUED PETITIONS FROM, OCTOBER 11, 2101 PUBLIC HEARINGS <br />• John & Lillian Chilingerian — Request a Variance from Section 174-32 of the Zoning <br />By-laws for permission to vary the fire protection requirements to allow for construction <br />of a single-family home on an unpaved road on property located in an R-3 zoning district <br />at 77 Horseshoe Bend Way (Map 40 Parcel 8) Mashp2e, MA. <br />John & Lillian Chilineerian — Request a Special Permit under Section 174-20 of the <br />Zoning By-laws for permission to demolish an existing dwelling to allow for construction <br />of a single-family home on property located in an R-3 zoning district at 77 Horseshoe <br />Bend Way (Map 40 Parcel 8) Mashpee, MA. <br />Sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br />Neither the Petitioner nor the builder represented the Petitions. Mr. Regan.moved to <br />Deny Without Prejudice the above -referenced Petitions. Mr. Nelson seconded.
