Gonsalves, Jr. V-99-3 2 <br /> FINDINGS <br /> General Finding <br /> 1. the subject property is located at 68 Seconsett Island Road and consists of <br /> 12,467 square feet. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner, <br /> Specific Finding <br /> I. the Board found that relief may be granted without detriment to the public <br /> good. <br /> 2. the Board found that relief may be granted without derogating from the intent <br /> or purpose of the By-laws. <br /> 3. the subject property is impacted by wetlands. <br /> 4. the proposed construction will be an improvement with the upgrade to a <br /> Title V Septic System. <br /> 5. the proposed construction will be an improvement of the setback <br /> requirements. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on January 13, 1999 to grant a <br /> Variance of four feet on the northeast side and a Variance of nine feet off of Seconsett <br /> Island Road. The permit is conditioned upon compliance with plans of Cape & Islands <br /> Engineering, being Plan No. S 111698, dated November 16, 1998, Scale: I"= 20 feet. <br />
