Sweeney SP-99-7 16 Summersea Road <br /> Map 104 Block 95 <br /> A Petition was filed on December 9, 1998 by Thomas G. Routhier and Joy <br /> W, Sweeney of Boston, Massachusetts for a Special Permit under Section 174-17 <br /> and Section174-20 of the Zoning By-laws for permission to demolish an existing, <br /> non-conforming dwelling and construct a three-bedroom dwelling on property located <br /> in an R-3 zoning district at 16 Surnmersea Road (Map 104 Block 95), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 22 and <br /> December 29, 1998, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 13, 1999, at 7:30 P.M., at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke of The Phoenix Group represented the applicants who plan <br /> to construct a three-bedroom home. He stated that the lot was developed in 1962 and the <br /> applicants are determined to maintain a minimum 10-foot sideline setback and 29-foot <br /> setback from the street. The proposed lot coverage is 19%. The applicants plan to replace <br /> the existing cesspool with the installation of a new Title V septic system. Mr. Grotzke <br /> stated that the Conservation Commission has approved th e project, <br /> Mi. Nelson questioned if the property comes under the wetlands concern. Mr. <br /> Grotzke stated that property is a defined resource area and impact on wetlands is only <br /> calculated when the proposed construction is below a wetland flagging and wetland line. <br /> No comments were received from abutters. <br />
