Town of Nashpee <br />a � <br />16 Great JVeck Y(oad Arth <br />n,�,E��• Mashpee, Massachusetts 02649 <br />BOARD OF APPEALS <br />DECISION FOR A MODIFICATION OF SPECIAL PERMIT <br />Re: Salrama, Inc. — Dick & Ellie's SP -99-33 650 Falmouth Road <br />Map 81 Block 4 <br />A Petition was filed on March 22, 1999 by Salrama, hic. of Lancaster, <br />Massachusetts for a renewal of Section 4 of the Modification of Special Permit <br />SP -95-32 to allow canopies and tent covers to remain overnight on property located <br />in a C-1 zoning district at 650 Falmouth Road (Map 81 Block 4) Mashpee, MA. <br />(Owner of record: Chatal Realty Trust). <br />Section 4 states that: "No structures of a permanent nature are to be constructed, <br />erected, or caused to be placed on the property used in connection with the flea market. <br />Merchandise, equipment, banners and other gear for use in connection with the Flea <br />Market are to be removed at the conclusion of each day's operation. Any poles which are <br />to be used by the applicant to support tents are not to be considered structures for the <br />purposes of this permit and canopies and tent sides used on these poles may remain <br />overnight for the 1998 season. All tent canopies and sides are to be of uniform color." <br />Notice was duly given to abutters in accordance with Massachusetts General Laws <br />Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br />of general circulation in the Town of Mashpee on March 26 and April 2, 1999, a copy of <br />which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, April 14, 1999, at 7:30 P.M. at which time the following members of the <br />Board of Appeals were present and acting throughout: James E. Regan III, James M. <br />Dorgan and Richard T. Guerrera. <br />Attorney Peter Campobasso represented the applicant. Michael Salvi, Joseph <br />Marrama and Attorney Anthony Feroci also attended the meeting. A memorandum was <br />received from the Police Chief, a copy of which is attached hereto and made a part hereof. <br />The Board agreed that the permanent barrier at the Deer Crossing entrance should be <br />closed from 10 A.M. and 5 P.M. Mr. Salvi and Mr. Marrama also agreed to improve the <br />trash pickup at the site. The Board agreed that all poles used on the site must be removed <br />at the end of the 1999 season. <br />
