Board of Appeals Salrama, Inc. — Dick & Ellie's SP -99-33 2 <br />Upon motion duly made and seconded on April 14, 1999, the Mashpee Board of <br />Appeals voted unanimously on the following: <br />1. to allow the modification of Condition 4. to allow canopies and tent covers to <br />remain overnight. <br />2. to require that a permanent barrier gate be installed at the entrance of the Flea <br />Market opposite the entrance to the Deer Crossing Condominiums entrance. <br />The gate is to be closed from 10 A.M. to 5 P.M. daily, except for emergencies. <br />to allow the modification of Condition 2 and require that a Police Officer be <br />stationed in the intersection of Route 28 and Donna's Lane/Job's Fishing <br />Road from 9 A.M. to 5 P.M. on the following dates: <br />Saturday and Sunday of each weekend beginning June 26 and continuing <br />through August 29. <br />Saturday, Sunday and Monday of Memorial Day weekend - May 29, 30 <br />and 31. <br />Saturday, Sunday and Monday of Labor Day weekend - September 4, 5, <br />and 6. <br />4. to incorporate into the decision the memorandum dated April 13, 1999 from <br />William C. Przybylek, Chief of Police. <br />The Special Permit is subject to the following conditions: <br />1. the applicant must comply with the existing conditions of the Special Permit <br />SP -98-31. <br />2. all tent canopies and sides are to be of uniform (silver or gray) color. All tent poles are <br />to be removed from the site at the end of the 1999 season. <br />3. vehicles, trailers, campers, tents, mobile homes, or other similar devices are not to be <br />used for human habitation or sleeping during the hours of 9:00 P.M. to 6:00 A.M., <br />with the exception that one camper may be used for one night watchperson <br />4. the applicant shall maintain the site. Paper, garbage and other debris shall be <br />removed from the grounds on a daily basis. All excessive vegetation shall be <br />trimmed, grass shall be mowed and landscaping maintained in a neat and orderly <br />manner. <br />5. the applicant shall post a $5,000 Performance Security to guarantee: <br />a. that the subject property is kept in a neat and clean manner, including final <br />cleanup at the end of the 1999 season. <br />b. that the tent poles will be removed at the end of the 1999 season. <br />c. that any fees owed to the Town of Mashpee including, but not limited to, Private <br />Duty Police Detail and the Board of Selectmen, are paid up to date. <br />
