Board of Appeals Salrama, Inc. — Dick & Ellie's SP -99-33 2 Upon motion duly made and seconded on April 14, 1999, the Mashpee Board of Appeals voted unanimously on the following: 1. to allow the modification of Condition 4. to allow canopies and tent covers to remain overnight. 2. to require that a permanent barrier gate be installed at the entrance of the Flea Market opposite the entrance to the Deer Crossing Condominiums entrance. The gate is to be closed from 10 A.M. to 5 P.M. daily, except for emergencies. to allow the modification of Condition 2 and require that a Police Officer be stationed in the intersection of Route 28 and Donna's Lane/Job's Fishing Road from 9 A.M. to 5 P.M. on the following dates: Saturday and Sunday of each weekend beginning June 26 and continuing through August 29. Saturday, Sunday and Monday of Memorial Day weekend - May 29, 30 and 31. Saturday, Sunday and Monday of Labor Day weekend - September 4, 5, and 6. 4. to incorporate into the decision the memorandum dated April 13, 1999 from William C. Przybylek, Chief of Police. The Special Permit is subject to the following conditions: 1. the applicant must comply with the existing conditions of the Special Permit SP -98-31. 2. all tent canopies and sides are to be of uniform (silver or gray) color. All tent poles are to be removed from the site at the end of the 1999 season. 3. vehicles, trailers, campers, tents, mobile homes, or other similar devices are not to be used for human habitation or sleeping during the hours of 9:00 P.M. to 6:00 A.M., with the exception that one camper may be used for one night watchperson 4. the applicant shall maintain the site. Paper, garbage and other debris shall be removed from the grounds on a daily basis. All excessive vegetation shall be trimmed, grass shall be mowed and landscaping maintained in a neat and orderly manner. 5. the applicant shall post a $5,000 Performance Security to guarantee: a. that the subject property is kept in a neat and clean manner, including final cleanup at the end of the 1999 season. b. that the tent poles will be removed at the end of the 1999 season. c. that any fees owed to the Town of Mashpee including, but not limited to, Private Duty Police Detail and the Board of Selectmen, are paid up to date.
