I� <br /> Town o Mashpee <br /> ��� 16 Great,Neck&ad<.ffortlz <br /> � " Aloshpee,Alassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 9,2022 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, February 9, <br /> 2022, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road <br /> North. Chairman, Jonathan D. Furbush, Board Members, William A. Blaisdell,Norman J. <br /> Gould, Associate Members, Sharon Sangeleer, George Ganzenmuller, Charlie Reidy, and <br /> Brad Pittsley were present. Also present was Building Commissioner, David Morris and <br /> Chris Gallagher. <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were <br /> being televised live on Mashpee TV as a virtual/remote meeting. He will take comments <br /> after each hearing. Absent from this meeting are Board Members, Ron Bonvie, Scott <br /> Goldstein and Robert Caggiano. <br /> PLEDGE OF ALLEGIANCE <br /> CONTINUED HEARINGS <br /> 30 Sand Dollar Lane: Owners,Jody and Alexandra Simes request a Special Permit under <br /> §174-17.1 of the Zoning Bylaws to raze and replace a three bedroom single family <br /> residence with a new three bedroom residence on property located in an R-3 Zoning <br /> District, Map 105 Parcel 84,Mashpee, MA. (Continued from January 12,2022 hearings <br /> at the request of the Attorney). <br /> Attorney Kevin Kirrane represented the Simes in connection with their permit application. <br /> Also present was Kevin Dauphinais, with Sandbox Design Studio, and Andrew Garulay <br /> with Yarmouth Port Design Group,who designed the landscaping.At the last hearing,there <br /> was an issue whether or not this building constituted a three story structure. It met the 35 <br /> ft. height requirement but there was a questioned raised relative to the third story. There <br /> was also a questioned raised relative to bringing in fill so the basement would not be <br /> considered a story. After that hearing, Kevin Dauphinais,met with Dave Morris,Building <br /> Commissioner and discussed modifications to the plan which would actually transform <br /> what was previously considered the second floor to a half story. These revised plans <br /> demonstrate the changes made to the design and floor plans. <br /> The Board may recall back in January that the plans depicted an entire second floor, and <br /> the revised plans now depict the second floor cut back leaving all the interior space as a <br /> half story space qualifying under the provisions of the bylaw as a half story. On the site <br /> plan there were two changes; one there is no need for the walls that were shown on the <br /> previous plans because given this scenario,there are no worries about the basement, and is <br /> now considered a story. There is no need to bring in fill or to argue that it is a half story. <br /> 1 <br />
