y'�AUILC " <br />Town ofMashpee <br />BOARD OF APPEALS 16 Great JVeck Pvoad Xorth <br />Decision for a Special Permit Mashpee, Massachusetts 02649 <br />Michelle A. & Michael Vizziello SP -99-50 42 Great River Road <br />Map 120 Block 71 <br />A Petition was filed on May 17, 1999 by Michelle A and Michael Vizziello <br />of Guilford, Connecticut for a Special Permit under Section 174-20 of the Zoning <br />By-laws for permission to demolish an existing structure and construct a new <br />two-bedroom dwelling on property located in an R-3 zoning district at 42 Great <br />River Road (Map 120 Block 71) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on June 4 and June 11, 1999, <br />a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, June 23, 1999, at which time the following members of the Board of <br />Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br />Robert G. Nelson. <br />This Decision is issued by the Mashpee Board of Appeals pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Michael Vizziello and Mr. Michael Corsi, his engineer, attended the meeting. <br />Mr. Vizziello stated that the existing structure was built in 1945 prior to zoning <br />regulations. The new construction will be in the same footprint as the existing structure <br />and a new foundation will replace the existing block foundation. <br />Mr. Vizziello replaced the septic system in February 1999. He submitted a letter <br />from the Board of Health requiring the installation of ultra -violet treatment to the septic <br />system. The Conservation Commission has also approved the project. <br />Mr. James Conery, an abutter, and his son attended the meeting. Mr. Conery <br />expressed concerns that more development will further erode the condition of the road. <br />Mr. Govoni suggested a compromise between Mr. Vizziello and Mr. Conery. Mr. <br />Vizziello agreed to grade the road to its present condition after completion of his project. <br />Mr. Govoni moved to take the application under advisement to allow the Board an <br />opportunity to establish Conservation Commission and Board of Health approval of the <br />proposal. <br />
