Thomas Ferrante V -99-51A <br />Board of Appeals <br />FINDINGS <br />General Findings <br />1. the subject property is located at 71 Timberlane Drive and consists of,14,690 <br />square feet. <br />Variance Criteria <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />not the district in which it is located and that a literal enforcement of the By-laws would <br />involve hardship to the petitioner. <br />Specific Findings <br />1. that relief may be granted without detriment to the public good. <br />2. that relief may be granted without derogating from the intent or purpose of the <br />By-laws. <br />3. that the subject property fronts on Santuit Pond and is impacted by wetlands. <br />4. that the Conservation Commission and the Board of Health have approved the <br />project. <br />5. that the installation of a new denitrification system will be an improvement to <br />the property. <br />In view of the foregoing, the Mashpee Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Board of Appeals voted unanimously on September 8, 1999 to <br />grant a Variance of 17.3 feet from the top of the bank to the wetlands to allow for the <br />demolition of the existing structure and the construction of a three-bedroom home. The <br />permit is conditioned upon compliance with plan entitled "Proposed 3 Bedroom <br />Dwelling, 71 Timberlane Drive, Mashpee, MA., C. Thomas & Iva Ferrante, 29 Edgehill <br />Road, Arlington, MA., Pesce Engineering & Associates., SCALE: 1" = 20', DATE: <br />3-29-99, REV: 7-16-99 and 8-26-99, JOB NO. 51631". <br />
