Florence V-99-69 2 <br /> Board of Appeals <br /> FINDINGS <br /> General Findings <br /> L the subject property is located at 110 Popponesset Island Road and consists of <br /> 39,375 square feet. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> Specific Findings <br /> 1. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 2. that relief may be granted without detriment to the public good. <br /> 3. that the subject property fronts on Popponesset Bay and is impacted by <br /> wetlands. <br /> 4. that the Harbormaster and the Conservation Commission have approved the <br /> project. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on September 8, 1999 to grant a <br /> Variance of 69.4 feet from the 6-foot contour line on the plan dated April 21, 1999 and <br /> Revised July 14, 1999, being plan entitled"Proposed Dock Plan for 110 Popponesset <br /> Island Road, Mashpee, MA 02649, Job Number 1846, Prepared for CSL Development <br /> Companies, Inc. 15 Cliff Road, Milton, MA 02186, Atlantic Design Engineers, Inc., P.O. <br /> Box 1052, Sandwich, MA 02563 ". <br />
