Town of Mashpee <br /> ZONING BOARD OF APPEALS 16 Great Veck load Vorth <br /> "'�AUIE La' Mashpee, Massachusetts 02649 <br /> Decision for Minor Modification to a Variance and a Special Permit <br /> RE: David M. &Karen Lupo V-99-44 and SP-99-45 65 River Road <br /> Map 89 Block 3F <br /> A Petition was filed on May 6, 1999 by David M. and Karen Lupo of Mashpee, <br /> Massachusetts for a Variance from Section 174-25.I.9 of the Zoning By-laws for <br /> permission to exceed the 70-foot pier length limit to allow for the construction of a <br /> 150-foot pier in Mashpee River on property located in an R-5 zoning district at 65 River <br /> Road(Map 89 Block 3F) Mashpee, MA. <br /> A Petition was filed on May 6, 1999 by David M. and Karen Lupo of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> permission to construct a pier, ramp and float in Mashpee River on property located in an <br /> R-5 zoning district at 65 River Road(Map 89 Block 317)Mashpee, MA. <br /> Upon motion duly made and seconded, the Zoning Board of Appeals voted <br /> unanimously on June 23, 1999 to grant a Variance of 74.5 feet from the dock length <br /> requirements. Upon motion duly made and seconded, the Board of Appeals voted <br /> unanimously on June 23, 1999 to grant a Special Permit. <br /> On September 27, 1999 the Board received a request from the applicant for a <br /> Minor Modification to the Variance V-99-44 and Special Permit SP-99-45. The Army <br /> Corps of Engineers requires that the ratio of dock width to dock height above wetlands to <br /> be equivalent to 1:1. The modification calls for four feet vertical distance from the <br /> bottom of the dock to the top of the salt marsh. <br /> On October 13, 1999 the Zoning Board of Appeals voted unanimously to grant <br /> the Minor Modification to the Variance and Special Permit. This is conditioned upon <br /> compliance with plan entitled: "The Phoenix Group, Proposed Dock, Lupo Residence, 65 <br /> River Road, Revised 2/5/99, 9/27/99, Project No.: 38771, Date: 15 July 1998". <br /> IN FAVOR: / <br /> INFAVOR: <br /> IN FAVOR: <br /> 9S ,1 Wd � I i30 66 <br /> rldTIO NAA101 <br />
