Please accept this application as a <br /> Drequest for a variance from section 174-31 of the Mashpee <br /> Zoning By-laws . Two copies of the form have been filed <br /> concurrently with the town clerk. <br /> Section 174-31 (Land space Requirements) requires a <br /> minimum setback of 40 from the front lot line. On behalf of <br /> Patricia Anne Sciuto, current owner of the property, we <br /> hereby request a variance of 20 feet from this minimum <br /> setback: <br /> There are unique topographical conditions on the lot <br /> that make it impossible to conform to this minimum setback. <br /> These conditions are as follows : <br /> 1 . The lot severely slopes from elevation 58 to <br /> elevation 32 or 26 feet over a distance of 90 +/- <br /> feet. <br /> 2 . The base of this severe slope is bordered by a <br /> wetland and pond. <br /> 3 . The lot dimensions are substandard by current <br /> zoning. <br /> The near proximity of the bordering vegetated wetland <br /> place this lot within the jurisdiction of the Conservation <br /> Commission.
