Board of Appeals Karen R. Carroll - V-98-19 2. <br /> A. General <br /> 1. the subject property is located at 12 Squaw's Lane and consists of 7,600 square feet.. <br /> 2. the immediate neighborhood consists of single family homes many of which have been <br /> improved with additions or reconstruction. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the.petitioner. <br /> C. Specific Findings <br /> I. the shape and small lot sizes in the Popponesset area create a hardship in the use of the <br /> land. <br /> 2. the proposed addition will be an improvement to the site conditions since there will be <br /> a new septic system and the addition will be elevated to meet the requirements of the <br /> flood zone. <br /> 3. the Board determined that desirable relief may be granted without derogating from the <br /> intent and purpose of the Zoning By-laws and without detriment to the public good. <br /> 4. the use is in harmony with the general purpose and intent of the Zoning By-laws. <br /> For the foregoing reasons the Board determined that the applicant met the criteria <br /> necessary to grant a Variance. ' <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously <br /> on February 11, 1998 to grant the Variance to allow lot coverage of 25.4%. The Variance <br /> is conditioned upon compliance with plans of Cape& Islands Engineering dated <br /> November 7, 1997. <br />
