Board of Appeals Mike's Service Station- SP-98-26 2. <br /> Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Chapter 6, require a finding that the extension, alteration or change shall not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming use. <br /> FINDINGS <br /> 1. The subject property is located at 135 Main Street (Map 37, Block 58) and has <br /> been operated as a retail gas station, towing company, auto repair and bus <br /> company for many years. <br /> 2. The lot now contains 1.4 acres and part of the lot was zoned for commercial <br /> use and occupied by the gas station in 1970. <br /> 3. There is adequate land area to provide sufficient parking. <br /> 4. The proposed use of the subject property through the expansion shall not be <br /> substantially more detrimental to the neighborhood than the existing non- <br /> conforming use. <br /> 5. The Board found that a Special Permit was necessary for the expansion of uses <br /> on the site. <br /> 6. The granting of this Special Permit shall not have a negative impact on traffic <br /> flow or safety. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> March 25, 1998 to grant the Special Permit subject to the following conditions: <br /> 1. a maximum of 6 U-Haul vehicles may be stored on the site at one time with <br /> only 2 vehicles to be parked in the front of the lot in spaces#5 and#6 and the <br /> other 4 parked in back. <br /> 2. no trucks longer than 14 feet may be stored on the lot. <br /> 3. hours of operation will remain 7:00 A.M. to 7:00 P.M. <br />
