Town of Mashpee
C4 1 1J
S "
16 Great Neck &ad JVorth
Mashpee, Massachusetts 02649
BOARD OF APPEALS
Decision for a Variance
RE: Merry Meadow Enterprises - V-98-23 22 Falmouth Road
Map 55 Block 8
A Petition was filed on February 17, 1998 Merry Meadow Enterprises Inc.
for a Variance from Section 174-31 of the Zoning By-laws for permission to vary the lot
size and frontage requirements on property located in a C-2 zoning district at 22 Falmouth
Road(Map 55, Block 24)Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper
of general circulation in the Town of Mashpee, on March 6 and March 13, 1998, a copy of
which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, March 25, 1998 at 7:30 P.M. at which time the following members of the
Board of Appeals were present and acting throughout: Edward M. Govoni, James E.
Regan III and Michael A. Makunas.
This Decision is issued by the Mashpee Board of Appeals pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Engineer John Slavinsky represented the applicant and explained that he had
presented an earlier petition requesting a sideline setback variance to allow for the addition
of a cooler to the Barn market located in Building 1. The Board found that the revised
plan would require a variance in lot coverage and frontage and determined that the earlier
plan was preferable to allow the owner the use of the land.
