Board of Appeals Merry Meadow Enterprises Inc. V-98-23 2. <br /> FINDINGS <br /> 1. the subject property consists of 1.23 acres of land at 22 Falmouth Road in a C- <br /> 2 zoning district. <br /> 2. the property contains pre-existing non-conforming commercial buildings <br /> known as the Merry Meadow shopping center. <br /> 3. the shape and topography of the lot prevent the placement of a cooler in any <br /> other location. <br /> 4. the topography affects this lot and not the district in which it is located. <br /> 5. a literal enforcement of the By-laws would result in hardship to the applicant. <br /> For the foregoing reasons the Board found that the applicant met the criteria <br /> necessary for the granting of a Variance. Upon motion duly made and seconded, the <br /> Board of Appeals voted unanimously on March 25, 1998 to grant a variance of 12 feet to <br /> allow for a sideline variance of 8 feet on the Northeast side. The Variance is conditioned <br /> upon compliance with Plan 1117997 by Cape& Islands Engineering. <br />
