Board of Appeals Todd Sullivan - V-98-24 2. <br /> FINDINGS <br /> 1. the subject property is located in a single family residential zone. <br /> 2. no evidence was presented to prove that the property had been used <br /> continually by more than one family <br /> 3. no evidence was presented to prove that multiple residential use of the <br /> property had not been abandoned. Section 174-19 of the Zoning By-laws <br /> states that any nonconforming use of land which is discontinued for a period of <br /> not less than twenty-four consecutive months shall be evidence of <br /> abandonment of a nonconforming usage and such land shall thereafter be used <br /> or developed only in terms of the zoning district in which such property is <br /> located. <br /> 4. the Board did not find that the use was in harmony with the general purpose <br /> and intent of the Zoning By-laws. <br /> For the foregoing reasons the Board determined that the applicant did not meet the <br /> criteria necessary to grant a Special Permit. Upon motion duly made and seconded the <br /> Board of Appeals voted on April 8, 1998 to deny the application without prejudice. <br />
