Board of Appeals Kenneth Litvack - V-98-30 2. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> Findings <br /> 1. the site contains 13,560 square feet improved with a single family home. <br /> 2. the Board determined that there was sufficient land area to relocate the <br /> proposed garage further away from the coastal bank. <br /> 3. the Board found that the applicant did not meet the hardship criteria for the <br /> granting of a Variance. <br /> Upon motion duly made and seconded, the Board of Appeals voted unanimously <br /> on May 13, 1998 to deny the application without prejudice. <br />
