Board of Appeals Robert M. and Shirley Bruneau -V-98-32 2. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> FindiM <br /> I. the Board determined that due to an engineering error the hardship was not <br /> self-imposed. <br /> 2. the lot appears on a recorded plan and was clearly intended to stand on its own <br /> and not part of adjacent developed land. <br /> 3. the lot has been assessed and taxed in the past as a separate and distinct <br /> buildable lot. <br /> 4. the lot is larger than many of the lots in the immediate area. <br /> 5. without relief, the lot could not be used for a residence, the purpose for which <br /> it had been laid out. <br /> 6. the Board found that granting of a Variance would not be a detriment to the <br /> neighborhood - <br /> Upon motion duly made and seconded, the Board of Appeals voted unanimously <br /> on April 8, 1998 to grant a Variance of 25 feet in frontage and a Variance in lot size of <br /> 33,440 square feet to allow 125 foot frontage and 43,560 in lot size, <br />
