A dol,q'I <br /> o-m"01*11% <br /> Town ofNashpee <br /> 16 Great Veck Ppad Aorth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for Variances <br /> RE: Willowbend Development Corporation Shoestring Bay Estates <br /> V-98-33 to V-98-67 <br /> A Petition was filed on February 27, 1998 by Willowbend Development <br /> Corporation of Mashpee, Massachusetts for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the minimum lot size requirement for the properties <br /> listed on Schedule A all of which are located in an R-3 zoning district and shown on Plan <br /> of Shoestring Bay Estates dated May 6, 1998, recorded with Barnstable County Registry <br /> of Deeds at Book 541, Page 26. Willowbend Development Corporation has the property <br /> under agreement from the current owners. Separate applications were filed for each lot, <br /> but for ease of administration, a combined hearing was held and this decision addresses all <br /> the applications. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on April 3 and April 10, 1998, a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held at the Mashpee Town Hall on Wednesday, April 22, <br /> 1998 and continued to May 13 and May 27, 1998 when it was closed at which time the <br /> following members of the Board of Appeals were present and acting throughout: Edward <br /> M. Govoni, Cheryl A. Hawver and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General law, Chapter 40A, Section 10 and Section 174-31 of <br /> the Town of Mashpee Zoning By-laws. <br /> Jack McElhinney, Vice-President of Real Estate Development, appeared before the <br /> Board and presented Willowbend's plans. Mr. McElhinney explained that the May, 1998 <br /> plan shows a re-lotting of the original 42 lot Definitive Subdivision Plan approved in 1985 <br /> by the Mashpee Planning Board. The applicant stated that in order to avoid difficult legal <br /> issues surrounding the checkerboarding issues WiIlowbend had gone to a new plan. On <br /> the new plan, the number of lots had been reduced to 3 7. All of the lots meet the required <br /> frontage, 35 lots require variances to meet the required lot area. <br />
