Jordan -V-98-28 2. <br /> FE%MINGS <br /> 1. the subject lot is located in the Popponesset area of Mashpee and contains <br /> 6,750 square fea <br /> 2. the immediate neighborhood consists of single family homes of similar size, <br /> many of which have been improved with additions, <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> Specific Finding <br /> I. the location of the lot at the comer of Shore Drive and Wilson's Grove <br /> requires front setbacks of 25 feet from each road and creates a hardship in the <br /> use of the land. <br /> 2. many of the homes in the area pre-date zoning requirements and are set much <br /> closer to the street than the subject property. <br /> 3. the topography and shape affect this lot and not the zoning district in which it <br /> is located. <br /> 4. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> Upon motion duly made and seconded,the Board of Appeals voted unanimously <br /> on April 22, 1998 to grant a variance of 2.4% on lot coverage to allow lot coverage of <br /> 22.4%, a variance of 5,8 feet from Wilson's Grove to allow a setback of 19.2 feet and a <br /> variance of 3.5 feet from Shore Drive to allow a setback of 21.5 feet. The Variance is <br /> conditioned on compliance of plans of Cape and Island Engineering revised April 23, <br /> 1998. <br />
