14. The applicant proposes to purchase this parcel of land and construct a single family <br /> residential structure thereon. This parcel of land was approved by the Planning Board <br /> pursuant to a Subdivision Plan which allowed for this development on Amy Brown Road, <br /> an unimproved way open to the public. The Planning Board did not require the roadway <br /> to be paved as a condition of its approval but did require certain improvements to said <br /> road to satisfy their minimum access standard. These improvements do not meet with <br /> minimum Fire Protection Standards established by Section 174-32. <br /> In addition, the Waquoit Bay ACEC line runs through this parcel of land in such a <br /> fashion so as to preclude any building on said parcel without relief from 174-85-86 <br /> (inclusive). <br /> The Applicant has also applied for relief from the setback requirements of 174-33 <br /> although there may be a question as to whether the ACEC or Flood Plan meets the <br /> definition of a Wetland as defined by G.L. C. 131 § 40. <br />
