Town qfMashpee <br /> 16 Great Xeck Pvoad North <br /> Nashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Robert and Carol Moore - V-98-74 67 Amy Brown,Road <br /> Map 115, Block 18 <br /> A Petition was filed on April 10, 1998 by Robert and Carol Moore of Waquoit, <br /> Massachusetts for a Variance from Sections 174-32, 174-84, 174-85, 174-86 and 174-33 <br /> of the Zoning By-laws for permission to construct a single family home on an unpaved <br /> road in an Area of Critical Environmental Concern(ACEC) on property located in an R-3 <br /> zoning district at 67 Amy Brown Road (Map 115, Block 18) Mashpee, MA. (Owner of <br /> record: Camlin Realty Trust), <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on April 24 and May 1, 1998, a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 13, 1998, at which time the following members of the Board of Appeals <br /> were present and acting throughout: Edward M. Govoni, James E. Regan 1H and Cheryl <br /> A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represented the applicants and informed the Board that the <br /> site is one of four lots created by action of the Planning Board which permitted <br /> development of these lots on an unimproved way on the condition that the proponent <br /> make certain improvements to Amy Brown Road. Those improvements were made and <br /> the covenants relating to development on these lots have been released. He explained that <br /> the lot is bounded on two sides by a fresh water wetland known as Lot 4 (Map 115, Block <br /> 19) which will be conveyed to the Town of Mashpee for open space purposes. <br />
