Domolky - SP-98-72 2. <br /> FINDINGS <br /> General <br /> 1. the subject lot contains 14,765 square feet on Spoondrift Cove. <br /> 2. the subject lot is located in New Seabury but was not included in the original <br /> Special Permit cluster subdivision. <br /> 3. the immediate neighborhood consists of single family homes many of which <br /> have been improved with swimming pools. <br /> Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Chapter 6, require a finding that the extension, alteration or change shall not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming use. <br /> Specific FindiW <br /> I. the proposed setback of the swimming pool will be 15 feet from Spoondrift <br /> Circle and will be an improvement since the house setback is 14.5 feet. <br /> 2. while the proposed addition of the pool will increase the non-conforming <br /> nature of the property due to an increase in lot coverage from 18%to 22%the <br /> Board determined that it will not result in a structure or use that is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> use. <br /> 3. the site is both adequate and suitable for the proposed use and provides <br /> adequate land area for parking.. <br /> 4. the site conditions will be improved with the addition of a Title V septic system <br /> and the addition of enhancement plantings to the buffer zone near the top of <br /> the existing seawall, <br /> For the foregoing reasons, the Board determined that the applicant met the criteria <br /> necessary to grant a Special Permit. Upo n motion duly made and seconded, the Board of <br /> Appeals voted unanimously on May 13, 1998 to grant the Special Permit. The permit is <br /> conditioned upon compliance with plans of Michael H. Grotzke revised March 16, 1998. <br />
