Soule - V-98-87 7 County Road <br /> Map 78, Block 80 <br /> A Petition was filed on May 11, 1998 by Philip A. and Jane A. Soule of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the rear setback requirements to allow a proposed barn to be constructed 5 feet <br /> from the rear property line on property located in an R-5 zoning district at 7 County Road <br /> (Map 78, Block 80)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 5 and June 12, 1998 a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 24, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: James E. Regan IR, Richard T. <br /> Guerrera and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> IN&. Soule represented his application and informed the Board that he planned to <br /> construct a bam 5 feet from the rear lot line. He explained that the location was necessary <br /> to maintain distance from the septic system and preserve the plantings on the lot. He <br /> explained that the site was once a nursery and has extensive plantings of mature trees. <br /> Comments were received from a direct abutter in favor of the application. <br />
