Board of Appeals Philip A. and Jane A. Soule- V-98-87 2. <br /> FINDINGS <br /> A. General <br /> 1. the lot contains 18,481 and is located in the Winslow Farms subdivision. <br /> 2. the immediate neighborhood consists of single family homes on lots of similar <br /> size. <br /> B. Variance Criteria <br /> Secti6n 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> C. Sp cific Findings <br /> I. the shape of the lot and the location of the septic system create a hardship in <br /> the use of the land and the placement of the barn on the lot. <br /> 2. the size and shape affect this lot and not the zoning district in which it is <br /> located. <br /> 3. the Board determined that relief may be granted without detriment to the <br /> public good and without derogating from the intent or purpose of the By-laws. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on June 24, 1998 to grant a variance <br /> to allow a 5 foot rear setback. The Variance is conditioned upon compliance with plans of <br /> John P. Doyle, III dated May 4, 1998. <br />
