Talbot - V-98-85 2. <br /> Gener <br /> 1. the subject lot is located at 16 Weather Crescent and contains 10,614 square <br /> feet. <br /> 2. the immediate neighborhood consists of single family homes on lots of similar <br /> or larger size. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> Specific Findings <br /> 1. the size and shape of the lot create a hardship in the use of the land for the <br /> placement of a garage on the lot. <br /> 2. the size and shape affect this lot and not the zoning district in which it is <br /> located. <br /> 3. the Board determined that relief may be granted without detriment to the <br /> public good and without derogating from the intent or purpose of the By-laws. <br /> In view of the foregoing, the Masbpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded,the Board of Appeals voted unanimously on June 24, 1998 to allow an 8.6 <br /> setback on the easterly side. The Variance is conditioned upon compliance with plans of <br /> 1. E. Landers-Cauley dated April 23, 1998. <br />
