(Owner of <br /> record: Daniel F. and Elaine C. Topping). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 5 and June 12, 1998 a copy of <br /> which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 24, 1998 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Cheryl A. Hawver, Robert G. <br /> Nelson and James M. Dorgan. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Engineer David Sanicki represented the applicant and informed the Board that the <br /> subject lot was created under R-75 zoning in 1959 and 1967. This required 75 foot <br /> frontage, 20 foot front setback and 7.5 feet side and rear setbacks. He informed the <br /> Board that the lot has been in separate ownership from contiguous lots and that other <br /> developed lots in the area have similar setbacks. <br />
