Board of Appeals Michael McCarthy- V-98-86 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject lot is located at 30 Jackbon Road and contains 7,500 square feet. <br /> 2. the immediate neighborhood consists of single family homes on lots of similar <br /> size. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> C. Specific Findings <br /> I. the size and shape of the lot create a hardship in the use of the land and the <br /> placement of a house of the lot. <br /> 2. the size and shape affect this lot and not the zoning district in which it is <br /> located. <br /> 3. the lot appears on a recorded subdivision plan. <br /> 4. the lot has been in ownership separate from any contiguous lots. <br /> 5. the Board determined that relief may be granted without detriment to the <br /> public good and without derogating from the intent or purpose of the By-laws, <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duty made and <br /> seconded, the Board of Appeals voted unanimously on June 24, 1998 to grant a variance <br /> to allow a 29 foot setback from Jackbon Road and a 16 foot setback from Youngbon <br /> Terrace. The Variance is conditioned upon compliance with plans of Cape& Islands <br /> Engineering dated May 5, 1998. <br />
