Board of Appeals Charles Wilson V-98-95 2. <br /> FINDINGS <br /> General <br /> 1. the subject property is located at 87 Uncle Edwards Road and contains 7500 <br /> square feet. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography that affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> result in hardship to the Applicant, ' <br /> Specific Finding <br /> I. the applicant submitted revised plans reducing the lot coverage from 26%to <br /> 22%by eliminating the farmer's porch. <br /> 2. the lot was created as a single lot in 1946 before the Town of Mashpee <br /> adopted its Zoning By-laws. <br /> 3. the proposed plan meets all the sideline, rear and front setback requirements. <br /> 4. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws. <br /> 5. the Board determined that desirable relief may be granted without detriment to <br /> the public good. <br /> 6. that there are circumstances relating to the shape and topography which affect <br /> the subject lot and not the district in which it is located. <br /> For the foregoing reasons the Board determined that the applicant met the criteria <br /> necessary to grant a Variance. Upon motion duly made and seconded, Board of Appeals <br /> voted unanimously on August 12, 1998 to grant the Variance. The permit is conditioned <br /> upon compliance with plans of Cape& Islands Engineering dated January 13, 1998, <br /> including updated revisions. <br />
