Board of Appeals Michael McCue - V-98-98 2. <br /> FMINGS <br /> 1. the undeveloped lot contains 30, 294 square feet and is in an area of lots of <br /> similar size which have been developed with single family homes. <br /> 2. Wheeler Road is a paved road to within 250 feet of the site. <br /> 3. a fire hydrant is located at the comer of the lot. <br /> 4. the unpaved section of Wheeler Road is accessible to vehicular traffic and is <br /> typical of many unpaved roads in the Town. <br /> 5. the lot has been maintained as a separate buildable lot on the assessor's records, <br /> 6. other than a building lot, said land could be put to no other profitable use, <br /> On the basis of these factors, the Board determined that a literal enforcement of <br /> the By-law would result in substantial hardship to the Petitioner and that desirable relief <br /> could be granted without nullifying from the intent or purpose of the Zoning By-law and <br /> without detriment to the public good. <br /> Upon motion duly made and seconded, the Board of Appeals voted unanimously <br /> on July 22, 1998 to grant the Variance to allow construction of a single family home. The <br /> Variance is conditioned upon compliance with plans of Cape&Islands Engineering dated <br /> May 29, 1998. <br />
