Board of Appeals MediaOne of Massachusetts, Inc, - SP 98-99 2. <br /> FINDINGS <br /> General <br /> 1. the subject property is located in the Mashpee Industrial Park at 47 Industrial <br /> Drive. <br /> 2. the subject property consists of 87,154 square feet. <br /> Special Permit Criteri <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations;that there will be no <br /> adverse affect on public health or safety;that there will not be an excessive demand upon <br /> community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C(2). <br /> Specific Findinj <br /> I, subject property is industrially zoned and radio and television facilities are an <br /> allowed use with a Special Permit from the Board of Appeals. <br /> 2. a Special Permit for the television transmission facility was granted in 1989. <br /> 3. there is adequate parking on the site. <br /> 4. the use will not create any excessive demand upon municipal services or <br /> facilities and will not have any significant impact upon environmental issues of <br /> water or air quality, wildlife habitat, noise vibration or electrical disturbance. <br /> 5. the use will not create unacceptable levels of trash. <br /> 6. the proposal was reviewed and approved by the Design Review Committee. <br /> 7. the Board found that the granting of a Special Permit would not be detrimental <br /> to the Town. <br /> Upon motion duly made and seconded the Mashpee Board of Appeals voted <br /> unanimously on July 22, 1998 to grant a Special Permit. The Permit is subject to <br /> compliancewith plans of Holmes and McGrath, Inc. revised May 27, 1998 and to a <br /> revised landscape plan approved by the Design Review Committee. <br />
