Board of Appeals Loewen Group SP-98-109 2 <br /> The projected capacity for 360 people requires 103 parking spaces, with 114 <br /> parking spaces being proposed. Right-turn in and right-turn out only access, as well as <br /> deceleration and acceleration lanes to facilitate traffic entering and exiting onto Route 151 <br /> are planned, Passage is also proposed to use the access already being used by the Fire and <br /> Police Departments to allow a left-hand turn. Mr. Kirrane indicated that the commercial <br /> use intended would be of a low impact nature, creating some traffic, but with very little <br /> demand on municipal use and no adverse impact on any resource area, The proposed <br /> construction conforms with zoning by-laws with regard to lot coverage. The applicant has <br /> been granted a Variance to modify the frontage and setback requirements on the property, <br /> Mr. Kirrane also submitted revised landscape plans in response to requests from <br /> the Design Review Committee for additional planting to screen the parking areas. He <br /> presented the engineering plans for the proposed building. <br /> Questions from the Board included concerns about the turn-around in the parking <br /> lot, dry wells, drainage and traffic entering and exiting. Memos from the Planning Board <br /> and the Design Review Committee were considered. No comments were received from <br /> abutters. <br /> Special Permit Criteria for Commercial Properties <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law <br /> requires that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations;that there will be no <br /> adverse effect on public health or safety;that there will not be an excessive demand upon <br /> community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors fisted in Section 174-24.C.2. <br /> FINDINGS <br /> I. the subject property is located at 127 and 137 Nathan Ellis ffighway and <br /> contains approximately 25 acres in C-I and R-5 zoning districts. <br /> 2. Mashpee Zoning By-laws (Section 174-25.E.6.) specifically allow mortuary, <br /> undertaking or funeral establishments upon grant of a Special Permit from the <br /> Board of Appeals. <br /> 3. the subject property is currently under agreement for the proposed <br /> construction of a 5600 square foot building. <br />
