Board of Appeals Edmund C. &Rosemary O'Rourke SP-98-115 2. <br /> FMINGS <br /> Gener <br /> 1. the subject property is located at 34 Great River Road and contains 21,700 <br /> square feet fronting on Great River. <br /> 2. the proposed dock will be accessory to an existing dwelling and is a <br /> permissible use within the R-3 zoning district upon grant of a Special Permit, <br /> 3. the length of the proposed pier, ramp and float does not comply with the <br /> provisions of the By-laws, but has been granted a Variance from the Board of <br /> Appeals. <br /> Special Permit Criteria <br /> Section 174-25.1.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation on the marine or coastal environment. <br /> Specific Findings <br /> I. the proposal for the ramp, pier and float has been reduced from 120 feet in <br /> length to 82 feet in length. <br /> 2. the proposal has been approved by the Harbormaster and Shellfish Warden <br /> whose responsibilities include safety on the water and protection of the marine <br /> environment. . 4 <br /> 3. the proposal will be reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> 4. the use is in harmony with the general purpose and intent of the By-laws, <br /> 5. rights to maintenance in perpetuity. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously im August 26, 1998 to grant the <br /> Special Permit for the construction of the pier, ramp and float. The permit is conditioned <br /> pon compliance with plans of Cape& Island Engineering dated July 21, 1998 and <br /> evised July 31 and August 5, 1998. <br />
